Both parties, based on the principles of equality and mutual benefit, have reached the following agreement on the provision of Internet Data Center (IDC) related services by IDC.Homes to the user.
1. Service Content and Standards
Service Scope: IDC.Homes provides the following services to the user, either individually or in combination: Virtual Private Servers (VPS), server hosting, bandwidth leasing, network access, domain registration, and related technical support services.
The specific service specifications, quantity, price, and validity period are based on the user's order as clearly indicated on the IDC.Homes website (idc.Homes) or confirmed in writing by both parties.
Service Quality Guarantee (SLA):

Network Connectivity: IDC.Homes guarantees the monthly network connectivity rate of the user will not be less than 99% (best effort basis).

This guarantee does not include scheduled maintenance time notified by IDC.Homes in advance.

Measurement Method: Network connectivity is measured based on the data from IDC.Homes' monitoring platform.

If there is a failure due to the carrier's backbone network issues, the downtime will be prorated based on the weight of the carrier (e.g., China Telecom 0.35, China Unicom 0.3).

Compensation for Unmet Standards: If the service quality is not met in any given month, the user has the right to request IDC.Homes to waive a proportional amount of the service fee for that month. The compensation rates are as follows:

If downtime exceeds 729 minutes but is less than 25 hours, 5% of the service fee will be waived.

If downtime exceeds 25 hours but is less than 72 hours, 20% of the service fee will be waived.

If downtime exceeds 168 hours, the entire service fee for that month will be waived.

2. User Rights and Obligations

Legal Use: The user agrees to comply with the "Cybersecurity Law of the People's Republic of China" and other applicable local laws and regulations. The user shall not use the service for any illegal purposes, including but not limited to:

Sending spam emails, network scanning, brute force attacks, launching Distributed Denial of Service (DDoS) attacks, etc.

Building websites or applications involving violence, fraud, infringement, pornography, etc.
-
Setting up illegal communication channels such as Sock5, ShadowSock for circumventing firewalls.

Reasonable Use of Resources: The user shall not continuously overuse server CPU, memory, IO, and network bandwidth, nor run software or scripts that severely affect infrastructure stability and performance.

Information Authenticity and Backup: The user must provide accurate and complete registration information. The user acknowledges that IDC.Homes does not provide data redundancy backup services. It is the user's responsibility to regularly back up important data such as websites, emails, and databases. IDC.Homes will not be held responsible for data loss due to the user's failure to back up.

Timely Payment: The user shall pay service fees in full and on time as agreed.
3. IDC.Homes Rights and Obligations

Service Provision: IDC.Homes shall provide stable and reliable services in accordance with the agreement and industry standards.

Privacy and Data Security: IDC.Homes shall carefully handle user information and take reasonable measures to protect the security of user data. User information will not be provided to third parties without the user's consent or legal authorization.

Technical Support Scope: IDC.Homes generally provides technical support related to server hardware, network connectivity, and other infrastructure, but does not include third-party panel installation, application debugging, website code modification, or other services beyond basic maintenance.

Violation Handling: If the user violates the terms of this agreement (specifically clauses 1 and 2 of Article 2), IDC.Homes has the right to take actions including warnings, service suspension, termination, or data deletion, without retaining data or providing a refund. The user shall bear full responsibility for compensating IDC.Homes or third parties for any loss caused by such violations.
4. Fees, Payments, and Refund Policy

Fee Payment: The user shall pay fees according to the prices and payment methods published on the official website or agreed upon in the order (e.g., bank transfer or USDT).
Refund Policy:

Scope of Application: This refund policy applies only to VPS monthly products.

48-Hour Unconditional Refund: The user may request an unconditional refund within 48 hours of purchase (after 24 hours, the refund will be issued to the user's account balance).
No Refund Circumstances:

Refund requests made after 48 hours from the purchase date.
-
Multiple purchases (over 2 units) or exchanges of products followed by refund requests.
-
Service suspension due to user violations of the service terms or other misconduct.
-
Usage exceeding 3GB of traffic or IP address being blocked.
Refund Fee:

For users with only one activated product: Refund fee = Paid amount × 10% + $0.4.

For users with multiple activated products: Refund fee = Paid amount × 8% + $0.3.
-
Balance and value-added services are not refundable.
5. Disclaimer
IDC.Homes shall not be liable for compensation in the following situations:

Service interruption or data loss due to the user's failure to pay on time or failure to renew.

Data loss or service inaccessibility due to user errors (e.g., accidental file deletion, incorrect configuration).
-
Service suspension due to violation of service terms by the user’s website or application content.
-
Service interruption or data loss due to force majeure events (e.g., upstream provider shutdown, financial collapse, defamation, war, earthquake, fire, policy changes, backbone network failure, etc.).
6. Agreement Effectiveness, Changes, and Termination

Effectiveness: This agreement becomes effective when the user selects to agree, completes the payment, or uses the service for the first time.

Changes: IDC.Homes reserves the right to amend this agreement. Changes will be announced through the website or other means. If the user disagrees with the changes, they may terminate the service. Continued use after changes implies acceptance of the revised agreement.

Termination: The user may request to terminate the service by canceling their account. IDC.Homes may also terminate the service due to the user's breach of the agreement or legal requirements. The user must settle any outstanding fees upon termination.
7. Dispute Resolution
If any dispute arises from this agreement, the parties shall resolve it through friendly negotiation. If negotiation fails, either party may submit the dispute to the competent court in the jurisdiction where IDC.Homes is located for resolution.
8. Miscellaneous

Both parties shall designate contact persons and promptly notify each other of any changes in contact information.

Any attachments to this agreement (if applicable) shall have the same legal effect as this agreement.
